Terms and Conditions
General Terms and Conditions
§ 1 Contracting Parties, Scope
- Contracts are concluded in the name of and for the account of tolingo GmbH (Local Court of Hamburg, HRB 102250, VAT ID: DE 814889279), represented by the Managing Director Jens Völkel, Kühnehöfe 3, 22761 Hamburg.
- The business relationship between tolingo GmbH (hereinafter “Beglaubigung24”) and the customer (hereinafter “Customer”) is governed exclusively by the following General Terms and Conditions in the version valid at the time of the order.
§ 2 Conclusion of Contract
- The Customer may select from the range of products offered by Beglaubigung24 from a variety of document types (certificates, diplomas, contracts, etc.) and, after uploading the document requiring certification and selecting the desired language combination consisting of “source language” and “target language”, place them in a shopping cart by clicking the “Add to cart” button. For some source languages (e.g. Ukrainian, Serbian), the Customer is asked by Beglaubigung24 to provide all names contained in the document in Latin script before completing the order. Subsequent changes are excluded and do not constitute grounds for complaint. By clicking the “Order with obligation to pay” button, the Customer submits a binding request for certification of the documents collected in the shopping cart. Before submitting the order, the Customer can view and change the data at any time. The request can only be submitted and transmitted if the Customer accepts these contractual terms and conditions by clicking on the “Accept Terms and Conditions” button, thereby including them in the request.
- Beglaubigung24 then sends the Customer an automatic confirmation of receipt by e-mail, in which the Customer’s order is listed again. The automatic confirmation of receipt merely documents that the Customer’s order has been received by Beglaubigung24 and does not constitute acceptance of the request. The contract is only concluded upon submission of a declaration of acceptance by Beglaubigung24, which is sent in a separate e-mail (order confirmation). In this e-mail or in a separate e-mail, but at the latest upon delivery of the certified translation, the contract text (consisting of the order, the General Terms and Conditions and the order confirmation) is sent to the Customer by Beglaubigung24 on a durable medium (e-mail or paper printout) (contract confirmation). The contract text is stored in compliance with data protection regulations.
- The contract is concluded in German.
§ 3 Delivery, Delivery Time, Availability
- The delivery times specified by Beglaubigung24 are calculated from the time of the order confirmation, subject to prior payment of the price for the certification. If no or no different delivery time is specified for the respective certification, delivery by e-mail as a PDF document will take 3–4 business days (Mon–Fri) and delivery by post will take 5–6 business days (Mon–Fri). The Customer can also select faster delivery of the digital copy in the form of 24-hour express delivery.
- If, at the time the Customer places the order, it is temporarily not possible to certify the document selected by the Customer, Beglaubigung24 will inform the Customer of this without delay in the order confirmation. If certification is permanently not possible, Beglaubigung24 will refrain from issuing a declaration of acceptance. In this case, no contract is concluded.
- If the document provided by the Customer contains criminal or unlawful content, Beglaubigung24 may refuse certification and refrain from issuing a declaration of acceptance. In this case, no contract is concluded.
- Beglaubigung24 only delivers to Customers whose billing address and delivery address are located in Germany.
- The express shipping option is available for the following products: birth certificate, marriage certificate, death certificate and driving licence. This shipping method is available for the following language combinations: EN/DE, DE/EN, ES/DE, DE/ES, IT/DE, DE/IT.
- The 24-hour express shipping option applies only to the digital copy of the product.
- The express option is available for a total of up to four pages of the products listed above. The delivery time for the original document remains unchanged (5–6 business days Mon–Fri by post).
- If, in addition to one of the products with the express option, a product that does not offer the express option is also in the shopping cart, this shipping method cannot be selected.
- Express delivery takes place within 24 hours on business days (Mon–Fri). An order placed at the weekend/on a public holiday will be processed by the end of the following business day.
§ 4 Retention of Title
Until payment has been made in full, the certified translations delivered remain the property of Beglaubigung24.
§ 5 Prices and Shipping Costs
- All prices stated on the Beglaubigung24 website include the applicable statutory value-added tax.
- Shipping at Beglaubigung24 is generally free of charge. In addition, there is an option to select digital express delivery within 24 hours for certain product variations.
- Goods are shipped by post. The shipping risk is borne by Beglaubigung24.
§ 6 Terms of Payment
- The Customer may make payment by credit card (American Express, Visa, Mastercard), PayPal, Apple Pay, Google Pay or purchase on account in cooperation with Klarna.
- Payment by invoice is carried out in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm. In this case, Beglaubigung24 assigns the claim to Klarna Bank AB (publ). Payment by invoice is subject to a positive credit check of the Customer. The payment period is 30 days from the provision of the certified translation. The Customer can view additional information on purchase on account at https://cdn.klarna.com/1.0/shared/content/legal/terms/28601/de_de/invoice.
- Payment of the price for the certification is due immediately upon conclusion of the contract.
§ 7 Warranty
Beglaubigung24 is liable for defects in accordance with the statutory provisions applicable, in particular §§ 634 et seq. BGB (German Civil Code).
§ 8 Liability
- Claims by the Customer for damages are excluded. Exempt from this are claims for damages by the Customer resulting from injury to life, limb or health, or from the breach of essential contractual obligations (cardinal obligations), as well as liability for other damages based on an intentional or grossly negligent breach of duty by Beglaubigung24, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary in order to achieve the purpose of the contract.
- In the event of a breach of essential contractual obligations, Beglaubigung24 is liable only for the foreseeable damage typical of the contract if such damage was caused by simple negligence, unless the Customer’s claims for damages arise from injury to life, limb or health.
- The limitations in paragraphs 1 and 2 also apply in favour of the legal representatives and vicarious agents of Beglaubigung24 if claims are asserted directly against them.
- The limitations of liability arising from paragraphs 1 and 2 do not apply if Beglaubigung24 has fraudulently concealed a defect or has assumed a guarantee for the quality of the item. The same applies if Beglaubigung24 and the Customer have made an agreement regarding the quality of the item. The provisions of the German Product Liability Act remain unaffected.
§ 9 Information on the Right of Withdrawal
1. Consumers generally have a statutory right of withdrawal when concluding a distance-selling contract, about which Beglaubigung24 provides information below in accordance with the statutory model. Paragraph 2 contains a model withdrawal form.
Information on the right of withdrawal
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us, tolingo GmbH, Kühnehöfe 3, 22761 Hamburg, Tel: +49 40 413 583 024, e-mail: hello@beglaubigung24.de, of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, which is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your notice of exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal
If you withdraw from this contract, we must refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.
If you have requested that the services begin during the withdrawal period, you must pay us an amount corresponding to the proportion of the services already provided up to the time at which you inform us of the exercise of the right of withdrawal in respect of this contract, compared with the total scope of the services provided for in the contract.
2. Beglaubigung24 provides information on the model withdrawal form in accordance with the statutory provisions as follows:

§ 10 Final Provisions
- Contracts between Beglaubigung24 and Customers are governed by the laws of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The statutory provisions on the restriction of the choice of law and on the applicability of mandatory provisions, in particular of the state in which the Customer has their habitual residence as a consumer, remain unaffected.
- If the Customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the Customer and Beglaubigung24 is Hamburg.
- Even if individual provisions are legally invalid, the contract shall remain binding in its remaining parts. In place of the invalid provisions, the statutory provisions, if any, shall apply. If this would constitute an unreasonable hardship for one of the contracting parties, however, the contract as a whole will become invalid.
§ 11 Online Dispute Resolution (ODR)
-
We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
